These general terms and conditions apply to your visit to and use of our website www.tta-volendam.nl (the "Website") and the Service, as well as to all information, recommendations, and/or services provided to you on or via the Website and the Service.

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING OUR SERVICES.

Taxi TTA – Volendam

Your contracting partner is Taxi TTA – Volendam, established in the Netherlands and with offices at Parallelweg 1L, 1131 DM Volendam, registered with the Chamber of Commerce under number 92470696.

What services does Taxi TTA – Volendam provide?

Taxi TTA – Volendam provides information and a means to obtain transportation services offered by drivers and vehicle providers (the "Transportation Provider"), which can be requested and paid for (booked) using the website operated by Taxi TTA – Volendam. All services that Taxi TTA – Volendam provides to you through your use of the website are hereinafter referred to as the "Service.".

How is a contract concluded between Taxi TTA – Volendam and you?

By using the Service, you enter into a contract with Taxi TTA – Volendam (the "Contract"). To use the Service, you must first register with Taxi TTA – Volendam. Upon registration, you are required to provide Taxi TTA – Volendam with your personal information, mobile phone number, and payment and/or credit card information. After you have successfully registered with Taxi TTA – Volendam, you will be provided with a personal account, which you can access with a password of your choice.

You must be 18 years of age or older to use the Service. If you reside in a jurisdiction that restricts the use of the Service based on age, or restricts the ability to enter into contracts like this one based on age, you must comply with such age restrictions and do not use the Service. If you are an individual, you represent that you are of legal age to form a binding contract, or, if you are registering on behalf of a legal entity, that you have the authority to enter into these Terms of Use and to bind the legal entity to them and register them for the Service.

How can the Service be used?

The Service allows you to submit a request for a Transportation Service to the Transportation Provider. Depending on your device (laptop, PC, or mobile device (smartphone/tablet)), the Service detects your location and sends information about it to Taxi TTA – Volendam. After your request and payment for your request/order, you will receive a confirmation showing the location where the Transportation Provider will pick you up. Taxi TTA – Volendam will make every effort to fulfill your request.

Your use of the Service

You warrant that the information you provide to Taxi TTA – Volendam is accurate and complete. Taxi TTA – Volendam reserves the right to review the information you provide at any time and to refuse the Service without giving reasons. You may only access the Service using approved means. Taxi TTA – Volendam is not liable if you do not have a compatible device or if you use the wrong software version. If you use the Service with an incompatible or unapproved device, Taxi TTA – Volendam reserves the right to terminate the Service.

By using the Service, you further agree that:

You will use the Service only for your own personal use and will not resell it to any third party;
You will not grant others permission to use your account;
You will not assign or transfer your account to any other person or legal entity;
You will not use an account subject to any rights of another person other than yourself without proper authority;
You will not use the Service for any unlawful purpose, including but not limited to sending or storing unlawful material or for fraudulent purposes;
You will not use the Service to cause a nuisance, inconvenience or distress;
You will not impair the proper functioning of the Network;
You will not attempt to damage the Service in any way;
You will not copy or distribute the Service or other content from Taxi TTA – Volendam without the written permission of Taxi TTA – Volendam;
You will keep your account password or any identification we provide to you which enables you to access the Service secure and confidential;
You will provide us with any proof of identity that we reasonably request;
You will only use an access point or 3G data account (AP) that you are authorized to use;
You will not use the Service with an incompatible or unapproved device;
You will comply with the applicable laws of your home country, the country, state and/or locality in which you are located while using the Service.

Taxi TTA – Volendam reserves the right to immediately terminate the Service if you fail to comply with any of the above regulations.

Payment

Use of the Service is not entirely free. Taxi TTA – Volendam reserves the right to introduce or adjust a fee for use of the Service. If Taxi TTA – Volendam decides to adjust such a fee, Taxi TTA – Volendam will notify you accordingly and allow you to decide whether to continue or terminate the Contract.

The applicable rates for the transportation services provided by the Transportation Provider can be found on the Website. These may be changed or updated from time to time by Taxi TTA – Volendam. It is your responsibility to stay informed of current rates for the transportation services.

Taxi TTA – Volendam will charge you for the transportation services provided. You agree to pay for all transportation services you purchase from Taxi TTA – Volendam, and Taxi TTA – Volendam may charge the transportation services (including any applicable taxes and additional fees) accrued through or in connection with your account to your bank account or credit card account, as provided when registering for the Service. You are responsible at all times for the timely payment of all fees and for providing Taxi TTA – Volendam with a valid credit card account for payment of all fees. Payments made are non-refundable.

Taxi TTA – Volendam uses a third-party payment processor (the "Payment Processor") to connect your bank account and/or credit card to the Service. The processing of payments or credits, if applicable, in connection with your use of the Service is subject to the terms, conditions, and privacy policies of the Payment Processor and the issuer of your bank account and/or credit card, in addition to these User Terms. Taxi TTA – Volendam is not responsible for any errors or omissions made by the Payment Processor. In connection with your use of the Services, Taxi TTA – Volendam will obtain certain transaction details, which Taxi TTA – Volendam will use solely in accordance with its Privacy Notice.

Indemnification

By accepting these Terms of Use and using the Service, you agree to defend, indemnify, and hold harmless Taxi TTA – Volendam, its affiliates, its licensors, and each of their respective officers, directors, other users, employees, attorneys, and agents from and against any and all claims, costs, damages, losses, liabilities, and expenses (including attorneys' fees and costs) arising out of or relating to: (a) your breach or violation of any term of these Terms of Use or any applicable law or regulation, whether or not referenced herein; (b) your violation of any rights of a third party; or (c) your use or misuse of the Service.

Liability

The information, recommendations, and/or services provided to you on or through the Website or the Service are for informational purposes only and do not constitute advice. Taxi TTA – Volendam will keep the Website and its content reasonably accurate and up-to-date, but does not guarantee that (the content of) the Website is free of errors, defects, malware, or viruses, or that the Website is correct, up-to-date, or accurate.

Taxi TTA – Volendam is not liable for any damage resulting from the use of the Website (or the inability to use it, but excluding death or personal injury), including damage caused by malware, viruses or inaccuracy or incompleteness of the Information or by the Website, unless such damage is the result of intent or gross negligence on the part of Taxi TTA – Volendam.

Taxi TTA – Volendam is further not liable for damage resulting from the use of electronic means of communication with the Website (or the ability to use them), including, but not limited to, damage from failure or delay in the delivery of electronic messages, interception or manipulation of electronic messages by third parties or by computer programs used for electronic messages and transmission of viruses.

Notwithstanding the foregoing, and to the extent permitted by mandatory applicable law, the total liability of Taxi TTA – Volendam shall in no event exceed an amount of EUR 500 or, if applicable, the equivalent of that amount in the currency used by you to pay for the transportation services to the Transportation Provider.

The quality of the transportation services requested through the use of the Service is the sole responsibility of Taxi TTA – Volendam, which ultimately provides such transportation services.

Licensing, Restrictions, and Copyright Policy

For the purposes of these Terms of Use, the following definitions apply:

Content means all content that appears or is displayed, including, but not limited to, logos, images, trademarks, text, graphic text, graphic representations, images, moving images, sound, illustrations, music, software, opinions, remarks, commentary, art, links, questions, suggestions, information or other material.
Taxi TTA – Volendam Content means Content that is owned by or used by Taxi TTA – Volendam, its affiliates or licensors and made available via the Website, Service, including Content licensed by a third party, but excluding User Content.
User means any person who accesses or uses the Service.
User Content means Content that a User posts, uploads, publishes, submits or transmits to make available on the Website or through the Service.
Shared content means the Content of Taxi TTA – Volendam and the User Content collectively.

Subject to your compliance with these Terms of Use, Taxi TTA – Volendam grants you a limited, non-exclusive, non-transferable license:

to view, download and print Content from Taxi TTA – Volendam solely for your personal and non-commercial purposes; and
to view all User Content that you may access solely for your personal and non-commercial purposes.

You do not have the right to sublicense the license rights granted in this section.

Except as expressly permitted in these Terms of Use, you may not use, copy, adapt, modify, create derivative works from, distribute, license, sell, transmit, publicly display, publicly perform, reproduce, transmit, play, broadcast, or otherwise exploit the Website, Service, or Collective Content. You may not reuse Collective Content without first obtaining the written permission of Taxi TTA – Volendam. No licenses or rights are granted to you, by implication or otherwise, under any intellectual property rights owned or controlled by Taxi TTA – Volendam or its licensors, except for the licenses and rights expressly granted in these Terms of Use.

License granted by User

At our sole discretion, we may permit Users to post, upload, publish, submit, or transmit User Content on the Website or through the Service. User Content will be deemed non-confidential and non-proprietary. Accordingly, Taxi TTA – Volendam shall have the non-exclusive, royalty-free right to use, copy, distribute, and disclose to third parties User Content for any purpose in any medium and throughout the world ("License Grant").

You acknowledge that Taxi TTA – Volendam acts solely as a passive conduit for the distribution of User Content and is not responsible or liable to you or any third party for the content or accuracy of any User Content. Taxi TTA – Volendam will not continuously monitor the User Content you publish or moderate User Content, nor will Taxi TTA – Volendam have any obligation to do so. Without limiting the foregoing, you acknowledge and agree that any comments, opinions, comments, suggestions, or other information displayed or included in User Content do not necessarily reflect those of Taxi TTA – Volendam.

Any use of User Content by you is entirely at your own risk. You represent and warrant that all User Content posted or transmitted by you is original with you and does not copy the work of any third party or otherwise infringe upon any third party's intellectual property rights, privacy rights, or publicity rights, and does not contain offensive or derogatory expressions. Furthermore, you represent and warrant that you have the authority to grant the license as provided in this paragraph.

You agree to indemnify Taxi TTA – Volendam, its affiliates, and its licensors against all costs, expenses, damages, losses, and liabilities incurred or suffered by Taxi TTA – Volendam or its affiliates in connection with any User Content posted or transmitted by you or your other use of the Website or the Service.

Taxi TTA – Volendam reserves the right, in its sole discretion, to block or remove (in whole or in part) any User Content posted or transmitted by you that Taxi TTA – Volendam believes does not comply with these Terms of Use (including materials that infringe or may infringe third-party intellectual property rights, privacy rights, or personality rights) or is otherwise unacceptable to Taxi TTA – Volendam.

You agree to immediately notify Taxi TTA – Volendam in writing of any User Content that violates these Terms of Use. You agree to provide Taxi TTA – Volendam with sufficient information to enable Taxi TTA – Volendam to investigate whether such User Content violates these Terms of Use. Taxi TTA – Volendam agrees to make good faith efforts to investigate such complaint and will take such action as Taxi TTA – Volendam deems appropriate in its sole discretion. However, Taxi TTA – Volendam does not guarantee or represent that it will block or remove such User Content (in whole or in part).

Copyright Policy

Taxi TTA – Volendam respects copyright and expects its users to do the same. It is Taxi TTA – Volendam's policy to terminate access in appropriate cases for users or other account holders who (repeatedly) violate or are deemed to (repeatedly) violate the rights of copyright holders.

Intellectual Property Law

Only Taxi TTA – Volendam (and its licensors, if applicable) owns all rights, title and interest, including all related intellectual property rights, in and to the Website and the Service and any suggestions, ideas, improvement requests, feedback, recommendations or other information provided by you or any other party relating to the Website or the Service.

These Terms of Use do not constitute a sale and do not transfer to you any rights or ownership in or to the Website or the Service or any other intellectual property rights owned by Taxi TTA – Volendam. The Taxi TTA – Volendam name, logo, and product names associated with the Service are trademarks of Taxi TTA – Volendam, its affiliates, or third parties, and no right is granted in any way
